三 | 经侦查发现，李某、廖某为首的犯罪团伙运营一批粉丝总量达2020余万的微博账号。他们专门瞄准新剧开播、综艺宣发等关键时段，捏造散布不实负面信息，通过多账号联动炒作话题、煽动粉丝对立来制造舆论压力。待影视公司、艺人经纪团队主动沟通后，李某、廖某并不直接提“删帖”，而是以“提供宣传服务”“舆情优化合作”的名义进行谈判，将删帖包装成“护剧”商业宣传行为，开口索要高额费用。若对方拒绝，他们便通过加大发帖频率、扩大传播范围的方式持续施压，直至对方“花钱消灾”平息风波。在彻底摸清团伙人员分工、组织架构与资金流向后，杭州公安调集市、区两级警力开展收网行动，现场抓获10名涉案人员，查获手机、电脑、平板等大量作案设备。目前，4名嫌疑人已被依法采取刑事强制措施，2名主犯经检察机关批准逮捕。“本案是全国首例明确将娱乐圈‘护剧’等灰色运作行为，依法以敲诈勒索罪立案侦办、从严深挖的典型案件。”杭州市公安局临安区分局网安大队副中队长李克介绍，该案属于文娱行业新型有组织网络犯罪，危害突出、隐蔽性强。团伙抓住文娱行业看重网络口碑的特点，以千万流量账号为筹码裹挟舆论实施敲诈；对外假借公关咨询、品牌维护等合法业务谈判，使用行业黑话规避监管，反侦查手段增加取证难度；团伙架构稳定、分工明确，长期专职搜集素材制造负面舆情，公司化、链条化职业作案，严重扰乱文娱行业正常经营与网络公共秩序。杭州公安提醒，各大影视机构、演艺从业者若遭遇舆情敲诈胁迫，切勿抱有花钱消灾的侥幸心理，私下妥协只会助长黑产气焰，应当第一时间留存网络舆情截图、聊天及交易凭证，主动向公安机关报案，依靠法律维护自身权益。
